5-8-06 General Michael Hayden to be head of the CIA

 

Today, President Bush has nominated General Michael Hayden to be head of the CIA however; one has to question his judgment on civil liberties, as he was the gentlemen most confused by the Fourth Amendment.

He stated that Intelligence agencies do not need "probable cause" all they need is a reasonable suspicion because the Forth Amendment does not require nor state reasonable cause is necessary Of course, if one was to actually read the Bill of Rights, you’d see the words “probable cause” in black and white.

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Also, he has expressed his willingness to ignore the FISA court law and instead he believes the President can authorize warrantless surveillance when he said "I have two paths in front of me, both of them lawful, one FISA, one the presidential -- the president's authorization."

Keep in mind, no where neither in the Constitution nor in law is the President granted the power to authorize warrantless surveillance.
